The Ifs & Buts of Home Improvement | Internet Revenue Articles

?

Home Improvement

It is quite the optimistic ? pessimistic paradox here when I say that home improvement can either be a very challenging task, or it can be a lot of fun. Whichever path you choose to improve your home, you want it to look good and you want to make sure that your choice of fixings is the best to keep your house durable and safe whenever harsh weather decides to knock at your door. Also one has to worry ?should I change my eaves lining sheets or replace weatherboards?? Let me help you out on this.

Cladding & Its Types:

One of the best and trusted ways to keep your home protected from vicious weather is home cladding. I always knew what home cladding was all about but was always confused what kind of cladding would work the best for me. There are many home cladding options available in the Australian market that one can choose from like; Brick cladding:Brick cladding is an exterior facing for a structure which is made from brick. Stone Cladding:Stone cladding is a thin layer of stone or simulated stone applied to a building or other structure made of a material other than stone. Stone cladding is sometimes applied to concrete and steel buildings as part of their original architectural design. Cement Cladding Metal Cladding Wood Cladding Vinyl Cladding

The Best Type of Cladding:

As we can see I had a wide variety of home cladding options to choose from and all the types of claddings are good in their own ways, however I would be greatly partial to vinyl cladding. Major benefits that I noticed were; Little to no Maintenance required Less Costlier than others More Eco-Friendly More Stylish and Fashionable Strong and Durable Easy Insulation

Vinyl Cladding:

Methods I also would want to discuss exactly what vinyl cladding is and what the material is made from. Vinyl cladding is one of the best cladding?s to use if you?re looking to help the environment because of the fact that it?s not made with so many different materials. This type of cladding is a few choice substances mixed in with polyvinyl chloride. Replacing weatherboards and changing eaves lining sheets is a major element of the vinyl cladding process.

So guys the next time you decide to improve your homes, do not forget Vinyl Cladding is the word and always improve your home from professionals.

Tsue ~ That's What She Said: Home DIY: Repairing Wicker Chairs

When we first purchased our home, I immediately had a vision of what I wanted to do with our screened, covered porch. ?Located off our family room with sliding door access and adjacent to the pool area, I knew immediately this would become the haven of our outdoor entertaining spaces. ?With expansive windows on every side lending to the feeling of connection to our other outdoor living areas, yet still a degree of separation, my first task was to outfit the area with comfortable seating.

With all manner of home remodeling projects underway, both in the interest of saving funds for other projects as well as for the challenge, I collected a number of wicker chairs, in varying designs and conditions, to pamper back to beauty. ?Although wicker is quite capable of holding its own outdoors, many of the pieces were in good need of cleaning.

Cleaning Outdoor Wicker Furniture

Collect and keep an assortment of bristled tools, such as old toothbrush, old nail brush and narrow and wide paint brushes. ?Paint brush bristles can be trimmed down to provide the stiffness you'll need to remove dirt. ?Brush away dirt as possible before using any liquid solution to clean. ?Mix up a solution of warm water and any mild detergent and gently scrub areas in need of attention. ?Tilt your wicker furniture piece to allow water to drain off, rather than soak and saturate the wicker. ?Use the minimum amount of water necessary to complete your task, blotting the piece dry with an absorbent towel when you are finished. ?Allow your piece to air dry at least 24 hours before use.

Binding Cane
Although each of my new to me wicker pieces were in relatively good shape, as is not uncommon, many of the chair legs' canning had loosened. ?Having inspected the pieces for damaged areas, I measured to determine the width I needed for my work ahead. ?There are a number of good resources for ordering chair canning supplies and one can easily find the type of cane needed in a wide variety of widths and types to match your projects needs.

Before using your binding cane, you'll need to soak it in a bucket of water overnight to soften it as it is quite stiff and difficult to bend when dry. ?This is a project I enjoyed working on outdoors and if the weather is balmy, I recommend leaving the cane you are not currently working with in your bucket until use as it will dry quickly in warmer weather.
Re-Wrapping Wicker Chair Legs
The tools needed for re-wrapping and minor repairs to your wicker chairs are simple and easy to work with. ?I used a small headed hammer, short, headed finishing nails and a utility knife or scissors. ?If using utility knife, having a small board or kitchen cutting board for DIY projects can be convenient, especially when working outdoors or away from your workbench. ?The process of wrapping is simple and steady work but requires time and patience. ?Having company, music or an audio book will help you keep pace and pass the time.

The Process

Re-wrapping your wicker chair legs is fairly simple. ?

  1. Trace the loose strand back to where it is still connected and trim.
  2. Layer the new piece of binding cane over the old piece, secure with ?finishing nail.
  3. Follow the existing wrap pattern, matching the angle as closely as possible. ?
  4. Secure with a finishing nail on the inside of the leg to reduce visibility every 4-6 layers.
  5. Secure the binding cane at the base of the leg one three sides, however take care to not wrap beyond the leg pole or you will soon be wrapping your legs again!
  6. From the base of the leg, wrap back up the leg 3 - 4 times, to reinforce, trim and secure with finishing nail.

Binder cane can also be used to make minor repairs to other loose or broken weave on your chair, although depending on the weave design of your piece, novices such as myself may find it best to trim and secure loose cane rather than take on a project beyond our ken.

When working with an eclectic mix of wicker styles and designs, painting them the same color and adding matching or coordinating weather resistant cushions can add cohesion to your space.

Learn how easily you can add a new look to your sun room, porch or patio from Plow & Hearth and enter to win a e-gift card to shop for new cushions or whatever may strike your fancy!

What DIY projects are you tackling this year?
What is your outdoor or seasonal room decor style?
Tell me in a comment below! ?I'd love to hear your thoughts!

Analysis: Striking Chicago teachers take on national education reform

(Reuters) - Chicago teachers walking picket lines on Monday, in a strike that has closed schools across the city, are taking on not just their combative mayor but a powerful education reform movement that is transforming public schools across the United States.

The new vision, championed by Chicago Mayor Rahm Emanuel and U.S. Education Secretary Arne Duncan, who used to run Chicago's schools, calls for a laser focus on standardized tests meant to gauge student skills in reading, writing and math. Teachers who fail to raise student scores may be fired. Schools that fail to boost scores may be shut down.

And the monopoly that the public sector once held on public schools will be broken with a proliferation of charter schools, which are publicly funded but privately run - and typically non-union.

To reformers, both Democrats and Republicans, these changes offer the best hope for improving dismal urban schools. Many teachers, however, see the new policies as a brazen attempt to shift public resources into private hands, to break the power of teachers unions, and to reduce the teaching profession to test preparation.

In Chicago, last-minute contract talks broke down not over pay, but over the reform agenda, both sides said Sunday. The union would not agree to Emanuel's proposal that teacher evaluations be based in large measure on student test scores.

Nor would the union accept his push to give principals more autonomy over hiring, weakening the seniority system that has long protected veteran teachers. Already, the demographics of the teaching profession in Chicago have notably shifted, as the private managers who run charter schools tend to favor rookie teachers who are younger and far less likely to be minorities, studies have shown.

Today, just 19 percent of the teaching force in Chicago is African American, down from 45 percent in 1995, the union says; organizers fear that shift means fewer teachers have deep roots in and passion for the communities where they work.

About 42 percent of the city's 400,000 public school students are black and 87 percent are low-income, according to district figures.

"This is fight for the soul of public education," said Brandon Johnson, an organizer with the Chicago Teachers Union.

Opponents reject such high-flying rhetoric as self-serving; they describe the union as an obstructionist force that stands in the way of progress for kids.

"This is a union very much concerned with job protection and job security," said Rebecca Nieves Huffman, who runs the local branch of Democrats for Education Reform, a coalition of wealthy financiers and entrepreneurs pushing to remake public schools.

"It's crazy to think if we keep doing the same model of school over and over, we'll get different results," said Juan Jose Gonzalez, the local director of Stand for Children, another reform group allied with the mayor. "Teachers need to decide if they're going to be part of this process or not."

AN AGGRESSIVE UNION

Teachers in Chicago - at least, a core group of them - long ago chose confrontation over cooperation.

That group spent two years quietly building support among teachers for their vision of a more aggressive union that would fight reform on principle as well as seeking to protect members' pay and benefits.

In June of 2010, the activist faction's candidate for union president, Karen Lewis, won the job. Her ascent symbolized the union's transformation to a "big, red fighting machine," said Debby Pope, a union official.

Pope discussed that strategy at the American Federation of Teachers' convention in Detroit earlier this summer. While the AFT carried on official business in the convention center, Pope held court for a handful of teachers and union organizers from across the United States in the back room of the Anchor bar.

She urged them to use aggressive tactics to resist a reform agenda that pins much of the blame for poor student achievement on bad teachers. In Chicago and elsewhere, teachers respond that the main problem is poverty; they say their students do poorly because they're hungry, because their lives are chaotic, because they don't have the eyeglasses they need or quiet places to do their homework.

"We say no, teachers are not the root of the problem," Pope told the group gathered in the bar. "The root of the problem is the way capitalism is destroying public schools."

Teachers have raised similar concerns elsewhere, but with limited success.

In the past three years, at least 20 state legislatures have passed bills setting up new teacher evaluation systems; many require student test scores to be the primary factor. (Teachers are typically rated not on how many students pass the test, but on how much growth students show from one year to the next.)

In some cities, teachers have worked with politicians and administrators to design evaluation systems they feel are fair. AFT President Randi Weingarten has praised that approach, which she calls "solution-driven unionism."

In Chicago, though, negotiations went nowhere.

"Nowhere else has a teachers union said, 'Enough is enough,' " said Mark Naison, a professor of African-American history at Fordham University and a union supporter. "This is ground zero of resistance to corporate education reform."

LONG HISTORY OF REFORM

The union stand comes in a city that's long been at the forefront of education reform.

In the late 1980s, U.S. Secretary of Education William Bennett condemned Chicago's public schools as the worst in the nation.

Ever since, civic leaders have been trying to fix them.

The first wave of reforms called for empowering citizens by creating hundreds of locally elected school councils across the city. That lasted just a few years, until the state stepped in to centralize control over Chicago schools in the hands of the mayor, who was to appoint a chief executive officer to run the district more like a business.

The first CEO, Paul Vallas, ushered in high-stakes testing: Thousands of students a year were held back a grade or denied entry into high school because they couldn't pass standardized tests.

Vallas' successor, Arne Duncan, took high-stakes testing a step further. Duncan closed scores of schools with poor test results. He remade others by firing the staff and hiring private turnaround specialists to run the schools. Duncan also encouraged the spread of charter schools.

Results have been mixed.

High-school graduation rates have improved and high-school test scores are up, according to an analysis last year by the Consortium on Chicago School Research at the University of Chicago. But test scores have barely budged at the elementary and middle grades.

And two decades of reform have done nothing to close the racial gaps in achievement levels. On the contrary, black students have fallen farther behind than ever, the consortium found.

Chicago also fares poorly compared to other cities. On the most recent national exam, Chicago fourth-graders didn't come close to the average scores posted by students in other large urban districts, in either reading or math.

There are some bright spots. Some elementary schools taken over by private turnaround specialists - and bolstered with millions in additional public and private funds - have boosted test scores significantly.

Some charter high schools, too, have dramatically raised scores and college matriculation rates among their low-income students, who must commit to spend hundreds more hours in the classroom than their peers and follow a rigid code of behavior.

"Parents have voted with their feet," said Michael Milkie, the CEO of the Noble network of charter high schools, which has thousands of families on its waiting list. If city leaders push ahead with plans to expand the charter network, including eight new Noble campuses over the next four years, "Chicago can serve as a model for the nation," Milkie said.

Yet teachers, backed by some civic activists, contend that while some charters stocked with highly motivated students have flourished, Chicago's reform policies have hurt public education overall.

They complain that regular neighborhood schools suffer with crumbling facilities and overcrowded classrooms while privately run charters and turnaround schools get pricey renovations, new equipment and additional staff.

And they argue that closing schools has destabilized poor neighborhoods and even sparked violence, as rival gangs end up crammed together into the schools that remain.

Some parents praise Mayor Emanuel for the courage to stand up to the unions and replace failing neighborhood schools with charters. "It's about our kids," said Fri Baez, whose third-grade daughter attends a charter school and is already planning for college.

Other parents, however, have yet to find their place in the new landscape.

Lisa Kulisek lives just a short walk from three magnet and charter schools with good reputations. But they receive so many applications, they choose their students by lottery. Kulisek said she has been told that her daughter, now in preschool, has less than a 10 percent chance of landing a slot. That would leave her to attend the only neighborhood school left in the area, which is farther away, posts terrible test scores, and primarily serves a destitute public housing complex.

Kulisek says she worries that by emphasizing charter schools the reforms have created a two-tier system.

"If everyone who can get out, does get out, there isn't going to be much of a system of public education left, and that terrifies me," she said. "For some of us, the public school system is all we have."

Real Estate Ideas That Can Have You Buying Like A Pro - PokerKy.net

Long-term value fluctuations in a property are a common concern for people looking to purchase a house or other real estate. Here are some home buying pointers.

Make sure your appraiser has five years under their belt before you hire them! If your real estate agency recommends an appraiser to you, find someone else. The appraiser will have conflicting interests, and may not be completely honest with you. You should also make sure that any appraiser you hire has either a state license or is state certified.

Make sure that you get a letter of approval first before you even make a bid on a house. Holding off on a mortgage approval lengthens any buying process and extending that can grow expensive.

Homes that need extensive repairs or renovations are often sold for cheaper than other homes. You will save money on the purchase, and you can use that money to repair and upgrade the home as you wish. In addition to customizing the home to your tastes, you are creating valuable equity each time you make an improvement. Take the potential of a property in consideration before letting the drawback discourage you. Your dream house might just be a diamond in the rough.

When you are in negotiations to buy a property, make a list of requirements that are deal breakers, and a list of issues you are willing to continue negotiating with. Separate your "needs" from your "wants" and construct a list with your expectations ordered by importance. The strength of your expectation dictates its priority to you. You must realize that few ever get everything they may want in a negotiation, so you must allow some issues to remain quite flexible.

Mortgage companies typically charge a minimum down payment, and you want to be sure you can cover it in its entirety. If you don't, you could wind up paying for private mortgage insurance, also known as PMI. PMI protects the bank and shows that you will make your payments; however, the extra cost adds up and your monthly payments will increase because of it.

Buying a home with more than one fireplace is expensive and unnecessary. It is difficult to clean more than one fireplace, and most people do not use them as often as they think they will.

Go online and use one of the many calculators to figure out how much you should spend on a home. This handy tool asks you to input your income, debts, and living expenses. The result will be a figure approximating what you can reasonably afford, without overextending your finances.

Don't be afraid to ask a seller for financial incentives when making an offer to buy. It is common to ask the seller to "buy down" the interest rate for a year or two. Adding financial incentives to offers will make sellers less willing to negotiate selling prices.

If you're buying a home for yourself, it's smart to bring somebody with you who knows about home buying. This person can be of valuable assistance simply because they may be able to point out flaws in the house that would otherwise have gone unnoticed. Try to get them to ask some things from the realtor.

Don't start searching for a house until you have a mortgage prequalification letter from the bank in hand. It is very discouraging to find the perfect home only to find you can't get a loan for it. Getting loans can be an arduous process that shouldn't be procrastinated.

Don't come on too strong in purchase negotiations. Many times people are too aggressive because they are trying to get the best price, and they end up losing out entirely. However, you should always stand firm on your wants. Allow your lawyer and Realtor to attend negotiations because they have experience in negotiating.

Do you feel ready to buy now? With the tips above, your answer is almost certainly "yes." Use this information to get the results you desire. Real estate buying does not need to be difficult. The idea of owning property is very invigorating. All you have to do is calculate its cost, and always make smart decisions.

Travel insurance myths debunked

? ? ? ? ? ? ? ? ??Most people who do not travel frequently usually have very little idea about the nooks and crannies of travel insurance. Here are some common myths and misconceptions about travel insurance that need to be clarified.

travel insurance myth

1.It?s easy to claim for cancellation or interruption cover

Most people who purchase travel insurance especially request to be reimbursed in case they have to cancel their trip. The ugly truth is, it is not easy at all to make this claim. Travel insurance companies are very strict in their investigation into cancellation cases, because this is the area where people can most easily try to trick the companies. Be prepared to substantiate your claim with concrete evidence of the inevitability of your cancellation!

2.Airlines will reimburse you for delays

Most airlines will not, unfortunately. Thus, you do need to dig your pocket for extra cover in your travel insurance scheme if you want to be compensated in times of prolonged delay!

3.Don?t buy travel insurance through travel agent

While it is true that purchasing travel insurance online will be cheaper, there is no harm in purchasing one through a reliable travel agent who charge reasonable commission price. A good travel agent has experience with insurance companies and can advise on product reliability.

4.Only unshophisticated travelers buy travel insurance

Many frequent travelers cannot even be bothered to purchase travel insurance because they have never faced any misfortune throughout their travelling life. However research reveals that those who buy travel insurance tend to be better educated, take longer and more expensive trips, usually the hallmarks of sophisticated travelers. Buying travel insurance is always a wise option only the more knowledgeable travelers know to do!

Ventre: 10 pressing questions for 2012

Jets QBs, Vick's health, troublesome Lions and Texans' title hopes just start of what's hot

Image: Sanchez, TebowReuters

Jets quarterbacks Mark Sanchez, left, and Tim Tebow are a QB platoon just waiting to sink, writes Mike Ventre.

OPINION

Michael Ventre

Only one question is irrelevant for the 2012 NFL season: ?Are we happy to have it back?? The answer is so obviously in the affirmative that one would be laughed off the planet for asking it.

But the season presents enough other questions to fill an Ivy League semester. And as we wait for it to get fully underway this weekend, here are 10 of the most pressing:

What will happen to the Mark Sanchez-Tim Tebow experiment?
Let?s answer that question with a question: What happens when you jump up and down on a pogo stick while holding a vial of nitroglycerin?

The good news for fans in both camps is that both quarterbacks are going to be equally ineffective. The Jets will lean on their defense ? not necessarily a good thing right now ? and disintegrate completely when asked to move the ball on offense. Sanchez is an ordinary quarterback with no weapons; Tebow is an extraordinary phenomenon who can?t play the position in the NFL. Together they add up to disaster.

Look for Greg McIlroy to get a serious shot at the job at some point, and look for the Jets to embark on a new quarterbacking direction in 2013.

Can the Lions tame themselves and concentrate on football?
Cornerback Aaron Berry was cut in July after an arrest for simple assault; he had been arrested earlier in the year on a DUI. Running back Mikel Leshoure was also arrested twice this past offseason. Defensive tackle Nick Fairley was arrested twice. Offensive tackle Johnny Culbreath was released after being arrested in January for marijuana possession. Ndamukong Suh, who has had several run-ins with the league office for on-the-field behavior, is facing a $1 million lawsuit over a car crash in December.

This isn?t a football team, it?s a remake of ?The Longest Yard.?

The Lions have a lot of talent and promise, but they run the risk of sabotaging themselves through self-generated distractions. The Lions need leadership to keep their young and unruly members in line. This is probably a make-or-break year for coach Jim Schwartz to see if he can direct the Lions toward making positive headlines on the field instead of notorious ones off it.

Will Michael Vick remain healthy and will he lead the Eagles to the Super Bowl?
No, and no. That was easy.

Michael Vick is like a housefly: He shows some impressive escapability, but eventually he?ll get swatted. And that super-duper flak jacket around his abdomen? Won?t help. He would need to pad himself like the Michelin man to make it through an entire NFL season. Vick will probably make it through the opener at Cleveland. But then he?ll face the Ravens, and they don?t much like houseflies.

Rookie Nick Foles may be quarterbacking this team by Week 3. Vince Young, no longer with the club, called the Eagles a ?Dream Team? before last season, but if and when Vick goes down with an injury, the dream will be like the kind experienced by a subject in a CIA experiment involving psychedelics.

Which of the five rookie starting quarterbacks will have the least success?
That would be Ryan Tannehill of the Miami Dolphins, and that would be through no fault of his own. He appears to have the makings of a fine NFL quarterback, and in time he?ll be one.

But of the five teams with rookie starters ? Colts (Andrew Luck), Redskins (Robert Griffin III), Browns (Brandon Weeden), Seahawks (Russell Wilson) and Dolphins (Tannehill), the Colts and Dolphins are the teams with new head coaches installing new systems and are the deepest in rebuilding mode. And in this comparison, Luck has the nod over Tannehill because Luck is a quarterbacking prodigy who is a little more mobile and better able to escape trouble. Tannehill does have Mike Sherman, his old Texas A&M coach, as offensive coordinator, so that will help some.

But the Dolphins had the 22nd-rated offense in the NFL last year, and they traded away Brandon Marshall. Tannehill won?t have an embarrassing year, and will show glimpses of excellence. Yet he?ll struggle more than the other four rooks.

Can the Giants repeat?

Absolutely. Don?t be misled by the opening loss Wednesday to Dallas. It?s one game, and they?re accustomed to scrambling their way through the season before finding postseason bliss. The Giants have all the requisite parts, especially a great defensive line and quarterback Eli Manning.

Also, remember that, when you get right down to it, they weren?t the champions of the 2011 season. They were only the champions of the tail end of it. They barely made the playoffs. They were 7-7 and then prevailed in their final two contests, against the Jets and Cowboys. They did a magnificent job once they got into the postseason, beating the Falcons in the wild card game at home, then knocking off the favored Packers and 49ers on the road before outlasting New England in the Super Bowl.

The point is this: The Giants don?t come into this season as fat cats, but as survivors. They?re not full of themselves after a 15-1 record in 2011 and a cruise through the postseason; rather, they?re still hungry with something to prove. They didn?t lose Wednesday because of overconfidence. They lost because Dallas wanted it more on that day.

And really, even though they?re defending Super Bowl champs, they?re flying under the radar, since NFC teams like the Pack, Niners, Bears, Lions, Saints and Eagles are getting more attention. It?s the ideal scenario for a repeat.

San Jose Steps Up Legal Action To Lure Oakland A's To The South ...

SAN JOSE (KCBS) ? The City of San Jose is stepping up is effort to lure the Oakland A?s to Silicon Valley, by filing a court order seeking to identify the organizational structure of a group opposed to the move.

City Attorney Richard Doyle believes the group ?Stand for San Jose? may be bankrolled by the San Francisco Giants, who are trying to block the A?s from moving to the South Bay. The Giants claim Santa Clara County as part of their territory.

The community group filed suit against the proposed ballpark in Downtown San Jose, alleging the environmental and traffic studies done on the site were flawed.

KCBS? Mike Colgan Reports:

San Jose Steps Up Legal Action To Lure Oakland A?s To The South Bay

?This is just a litigation tactic typical of someone who?s trying to kill a project, but we?re prepared to fight,? Mayor Chuck Reed said.

Santa Clara County Assessor Larry Stone, also a longtime local baseball booster, said he doesn?t need a court order to tell who the real players are.

?This is the Pillsbury Law Firm that?s doing this; a very expensive high-powered San Francisco law firm. I don?t think a group of individual San Jose residents can afford to buy the Pillsbury Law Firm,? Stone alleged.

Giants Spokeswoman Staci Slaughter said the team had no comment, honoring Major League Baseball Commissioner Bud Selig?s request not to talk about the matter.

Asian stocks down as US manufacturing disappoints

BANGKOK (AP) ? Weaker-than-expected U.S. manufacturing figures, just days after China announced its own production slowdown, sent Asian stock markets down Wednesday.

A measure of U.S. manufacturing activity ticked down from 49.8 in July to 49.6 in August, according to the Institute for Supply Management, a private trade group. It was the third straight month of a reading below 50, which indicates a contraction.

The U.S. report comes amid shrinking factory activity in almost every major economy, including the 17-country eurozone, Britain, China, Japan and Brazil. In China, factory activity fell last month to its lowest level in more than three years.

Japan's Nikkei 225 index fell 0.8 percent to 8,703.32. Hong Kong's Hang Seng lost 1.1 percent to 19,211.25 and South Korea's Kospi dropped 1.5 percent at 1,878.50. Australia's S&P/ASX 200 shed 0.6 percent to 4,277.60.

Investors are remaining cautious while awaiting a meeting of the European Central Bank on Thursday, during which President Mario Draghi is expected to announce details of a new bond-buying program intended to help countries with high borrowing costs such as Spain and Italy.

Additionally, the weakness in U.S. manufacturing may help persuade the Federal Reserve to announce new action after its meeting next week.

"If we don't see any good, positive catalyst, investors will be very reluctant to buy stocks at this point. We are waiting for the ECB, U.S. jobs data and other major U.S. economic data," said Jackson Wong, vice president at Tanrich Securities in Hong Kong.

Other analysts cautioned that central bank actions may be too little to protect markets from volatility through the end of the year.

"Whether upcoming ECB and Fed actions will be sufficient to prevent an escalation in risk aversion is debatable especially as markets have already priced in a lot of potential action," analysts at Credit Agricole CIB in Hong Kong said in a market commentary.

Further headwinds came Monday, when Moody's ratings agency warned that it could downgrade the credit score for the European Union as a whole, citing the mounting financial strain of the crisis on key countries such as Germany and France.

These countries are not only exposed to the higher costs of rescuing weaker countries but their industries are also suffering from weakening demand.

Among individual stocks, shares of Lenovo Group plunged 6.8 percent in Hong Kong after news reports said NEC Corp. announced it will sell its entire 2.7 percent stake in the Chinese PC maker.

In Hong Kong, China Minsheng Banking Corp. dropped 5.5 percent and China Merchants Bank Co. fell 2.8 percent due to concerns about growth and asset quality, analysts said.

On Wall Street, stocks ended mixed Tuesday. The Dow Jones industrial average fell 0.4 percent to close at 13,035.94. The Standard & Poor's 500 index fell 0.1 percent to 1,404.94.

The Nasdaq composite rose 0.3 percent to 3,075.06 after Apple, the index's biggest stock, rose $9.73 on speculation that the company was preparing to announce its iPhone 5 next week.

Benchmark oil for October delivery was up 1 cent to $95.31 a barrel in electronic trading on the New York Mercantile Exchange. The contract fell $1.17 to finish at $95.30 per barrel on the Nymex on Tuesday.

In currencies, the euro fell to $1.2536 from $1.2571 late Tuesday in New York. The dollar fell to 78.41 yen from 78.45 yen.

(AP) ? Michael Jackson's estate will begin making its case to a jury that a businessman working with the singer's mother should be forced to pay millions of dollars for infringing on several copyrights.

The amount is the sole issue at stake in a trial set to begin on Tuesday against Howard Mann, who has collaborated with Katherine Jackson on several projects, including a book.

A judge has already ruled that Mann violated Jackson estate copyrights and ordered his website shut down. His attorneys argue the estate doesn't actually own the proper rights and the ruling should be tossed out, but a judge has refused to reconsider his ruling.

The infringed works include cover art from Jackson's posthumous film "This Is It," and a silhouette of the singer dancing to his hit "Smooth Criminal."

The estate's case is expected to hinge on one expert witness who has estimated the cost of a license for the works is between $5 million and $12 million.

Mann's attorneys rejected a settlement offer last week of $2 million. Jackson's estate, who sued over the works in January 2011, is also asking that Mann be forced to pay its attorneys' fees.

Mann's lawyers have sought to introduce evidence that they were given bad legal advice about having to license the works, and have considered calling Katherine Jackson as a witness. The Jackson family matriarch is one of the beneficiaries of the singer's estate, along with his three children.

U.S. District Judge Dean D. Pregerson has noted that Mann doesn't appear to have the resources to pay a large judgment.

Save Invest Give: My Reasons for Individual Stocks

Why buy individual stocks?

That is the question I asked a couple of weeks ago in a post where I explained that for certain kinds of portfolios, the costs of individual stocks can be equal to or less than funds or ETFs.? A reader asked if I wouldn't mind addressing a more complicated concern about individual stocks: the widely discussed fact that most investors substantially lag the market.

I will warn you up front that this whole post is probably going to sound evasive.? Like a lot of financial questions, I don't like how it is framed.? The purpose of this post is to show the complexity of the question and the backdrop behind it.? If reading this article puts a lot of uncertainty in your mind, then I've done my job.? My argument is not that individuals can or can't beat the market, because frankly I don't know and I tend to think a "yes" or "no" is not a helpful answer.

My Personal Biases

I have been a student of the markets for more than 25 years, and I respect the price discovery mechanism in markets immensely.? Thus, I am not the kind of person who thinks "investing is easy".? You have no idea how much I cringe when I read articles purporting to tell people it's simple and straightforward.? I also believe most lists of "5 Stocks To Own Now" are misguided (at best).? Worst of all,?I'm especially irritated when I read articles where people brag about how they started investing a year?ago, how they bought a half dozen stocks that have outperformed the indexes, and how this proves that they're amazingly smart and investing is really easy.

And yet...

I confess that I buy individual stocks myself.? So do I think I'm smarter than the market?? No.? Am I just emotional and can't practice what I preach?? No.? Am I just delusional?? I hope not.? Let me try to explain...

How People Underperform The Market Indexes

Although there are a thousand reasons why people mess up, the mechanics of what happens can all be generalized to just a few problems.? This is not rocket science.? If someone underperforms the indexes, one of the following issues occurred:

  • Bad Timing.? This is the major reason.? Index returns assume continuous holding of your investment.? In contrast, a lot of people jump in and out of the market, and most of those people time the market very badly.? Note that this mistake is not limited to individual stocks.? Many people jump in and out of index funds or other vehicles as well, usually reducing their returns substantially.
  • Bad Selection.? You would think that stock picking would be easier than market timing, but evidently it's not quite so easy either.? Actively managed funds have every incentive to beat the markets, have the resources to perform extensive research, and (usually) have a mandate to avoid market timing.? Yet almost none of these funds perform better than the indexes over long periods of time.
  • Bad Diversification.? While I agree that in some ways this is just a variant of bad selection,?I believe it's a slightly different scenario.?If someone picks 100 stocks and they return far less than the market averages, then I think it's fair to say that person is just not good at picking stocks.? But if someone only picks one stock, how do we really know if they are skilled or not?? We have almost no sample size.? In my mind, the person who picks only one stock has only gambled, and has not really tried to pick stocks.? If someone thinks they are really so skilled at picking good stocks, then why can't they pick 25 good stocks instead of one or two?
  • Bad Allocation.? Yes, this is also bad selection in a way because it's the selection of different asset classes.? In the case of asset allocation, however, we generally do not assume that one should even be attempting to find and pursue the combination of assets that has the highest return.? Individuals may pursue different asset allocations based upon their age, risk tolerance, tax circumstances, and other factors.? Hence, we often don't know what the baseline should be.? If an investor outperforms the S&P 500 because he purchased small caps when they were in vogue, is this a sign of superior investing, or would we see underperformance if compared to the S&P 600?? Individual investors often do not state their asset allocation objectives, making performance comparisons difficult.? Yet many investors do intuitively gravitate towards allocation strategies with which they feel comfortable.

How People Outperform the Indexes

So in order to outperform the indexes, someone needs to reverse the items above.? We need superior timing, selection, diversification, allocation, or some combination thereof.? I agree most people will probably not find a suitable combination.? However, I would also guess that if someone was serious enough to understand the basic ideas above, they might very well get a lot closer.

Clearly people do outperform the indexes.? The question is not only how long it can be sustained, but more fundamentally, whether the outperformance is simply luck.? With enough investors on the planet, surely some people were just lucky.? In some cases, this may be obvious.? For example, if someone just happens to invest 100% in stocks during a bull market, and then?puts all the money into bonds at the top of the stock market at retirement, this would generally be considered luck.? But what about the person who does well researching and selecting stocks?? He, too, may just be lucky...or he may have skill.? I don't think we can really know.? Statistically, the number of years it would take to?prove someone is skilled (instead of lucky) is simply too much for one lifetime.

Why I Buy Stocks

So here are my personal reasons for buying individual stocks.? They will probably surprise.

  • I enjoy constructing portfolios from scratch.? It is fun for me.? Hence, if I only duplicate the return of the indexes, I don't feel like I wasted all that effort.? Now if I thought I would substantially underperform, that would be quite an expensive hobby, wouldn't it?? But I am fine with achieving the market returns after all my work.? I am not swinging for the fences.
  • What I'm really looking for is lower risk.? I'm not attempting to achieve higher returns at market risks, but market returns at lower risks.? This is not a typical objective for small investors, and it is not well served.? For example, the DVY ETF is interesting, but why should I pay 40 basis points in annual fees and allow them to put 1/3 of the portfolio in the utilities sector?
  • Hand selected portfolios bring greater clarity and confidence.? If I could buy funds where the 10 top holdings always included names I could believe in, I probably would stop buying stocks myself.? But invariably, I see things I don't want.? This makes it harder to avoid the timing and other issues mentioned above.? If you truly believe in your own diversification and selection, perhaps you will avoid subpar timing and allocation.? On the other hand, investors are notoriously overconfident, aren't we?? At any rate, these are my reasons.? I'm well aware that the jury is still out.
